High Court miffed over ‘divorcee’ tag in court cases

The Court noted it as “painful” to see how a woman even as of today is being treated.

Srinagar, Feb 14: The High Court of J&K and Ladakh has called for overthrowing the practice of labeling a woman as “divorcee” even as it wanted in place a circular-instruction that pleas with cause-title of such expression against the name of the woman be not registered or diarized.

A bench of Justice Vinod Chatterji Koul called for crushing the practice and urged for the need of issuance of circular-instruction that any motion, petition or appeal if found to have the cause-title with such word or expression against the name of woman should not be diarized or registered. The Court noted it as “painful” to see how a woman even as of today is being treated.

“If a woman is being labelled and shown as “Divorcee”, as if it is her Surname or Caste, then a man, who divorces his wife, is also to be called and suffixed as “Divorcer”, which, however, would be a bad practice,” the court said.  “Such a practice should be stopped rather crushed”, the court added.

The Court held that “henceforth if any motion, petition, or appeal indicates and reflects in its cause-title the word Divorcee against the name of a woman, such a plea should not be diarised or registered muchless entertained”. “To stop such a practice, a circular-instruction is required to be issued,” the court said. The Court urged that such instructions should also be issued to the Subordinate Courts. The Court directed its Registrar Judicial to place the present judgement before the Chief Justice for passing of “kind orders and issuance of circular instructions”.
